Agreement to Terms

By accessing or using the Apexion Health website and telehealth platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services. These terms apply to all visitors, patients, and others who access or use our platform.

Eligibility

You must be at least 18 years of age and a legal resident of a state in which Apexion Health operates to use our telehealth services. By using this platform, you represent and warrant that you meet these requirements.

Telehealth Services — Not Emergency Care

Apexion Health provides telehealth consultations that connect you with independent, licensed healthcare providers. Our platform is not a substitute for in-person emergency care. If you are experiencing a medical emergency, call 911 or go to your nearest emergency room immediately.

Completing an online health assessment does not guarantee a prescription or treatment plan. All prescribing decisions are made solely by licensed providers based on clinical evaluation. Apexion Health does not practice medicine or provide medical advice — that responsibility rests with your treating provider.

Compounded Medications & FDA Disclosure

Apexion Health works with state-licensed 503A and 503B compounding pharmacies to fulfill prescribed medications. Compounded medications are not FDA-approved drug products. The FDA has not evaluated these products for safety, efficacy, or quality in the same manner as commercially manufactured drugs. These products are intended for use by specific patients pursuant to a valid prescription.

Statements made on this platform regarding health benefits have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease. Individual results may vary.

Prescriptions & Treatment Plans

  • Prescriptions are issued at the sole discretion of your treating provider. Apexion Health does not guarantee that a prescription will be issued following your consultation.
  • You agree to provide accurate, complete, and up-to-date health information. Withholding relevant medical history may affect your safety and the quality of care you receive.
  • Medications are dispensed only after a valid prescription is issued by a licensed provider and confirmed by the pharmacy.

Payments & Billing

  • All fees are charged at the time of service or upon shipment, as disclosed during checkout. We accept the payment methods shown on the platform.
  • Subscription or recurring treatment plans are billed on the cycle shown at enrollment. You may cancel at any time by contacting us before the next billing date.
  • We reserve the right to update pricing at any time. Changes to subscription pricing will be communicated with reasonable advance notice.

HIPAA & Health Information

We are committed to protecting your protected health information (PHI) in accordance with applicable federal and state law, including HIPAA. Please review our Privacy Policy for details on how we collect, use, and safeguard your information.

Prohibited Conduct

  • Providing false or misleading health information during your assessment.
  • Sharing, reselling, or transferring prescribed medications to another person.
  • Attempting to obtain prescriptions for non-therapeutic or non-personal use.
  • Misusing the platform (unauthorized access, scraping, interfering with its operation, or attempting to reverse-engineer any part of the service).

Disclaimer of Warranties

The Apexion Health platform and associated services are provided “as is” without warranties of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses. Your use of the platform is at your own risk.

Limitation of Liability

To the maximum extent permitted by applicable law, Apexion Health, its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or services, even if we have been advised of the possibility of such damages.

Governing Law

These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page with a revised “Last updated” date. Continued use of the platform after changes become effective constitutes your acceptance of the revised terms.
